United Transfer Policy Doesn't Violate ADA, 7th Circ. Says

Law360, New York (March 7, 2012, 4:52 PM EST) -- The Seventh Circuit on Wednesday affirmed that the Americans with Disabilities Act does not require employers to reassign disabled employees to positions they can better handle, denying the Equal Employment Opportunity Commission's appeal of a lower court's ruling for United Air Lines Inc.

A three-judge panel refused to reconsider its 2000 ruling in EEOC v. Humiston-Keeling that the commission contended was undercut by the U.S. Supreme Court's 2002 US Airways Inc. v. Barnett ruling, saying that the Seventh Circuit had many times affirmed the precedent set...
