FTC Says Hospital Takeover Was Anti-Competitive

Law360 (August 6, 2007, 12:00 AM EDT) -- In a blow to Evanston Northwestern Healthcare Corp., the Federal Trade Commission has affirmed an administrative law judge’s previous ruling that the health care system’s 2000 acquisition of Highland Park Hospital was anti-competitive.

The FTC’s administrative opinion and order, which was made public on Monday, affirmed an October 2005 ruling by Chief Administrative Law Judge Stephen J. McGuire that the transaction violated Section 7 of the Clayton Act.
