FTC Says APEC Members Can't Hide Behind Privacy Rules

Law360, Washington (March 8, 2012, 8:20 PM EST) -- Federal Trade Commissioner Edith Ramirez warned companies Thursday that upcoming cross-border privacy rules for the Asia-Pacific region would not provide a safe harbor that would insulate them from enforcement actions.

While the FTC will take companies’ certification to the Asia-Pacific Economic Cooperation’s guidelines for data transfers in the region into consideration when probing companies’ data security practices, this commitment won’t automatically exempt companies from the agency’s scrutiny, Ramirez said during the International Association of Privacy Professional’s annual global privacy summit.
