DOJ Defends FOIA Response In Kagan Health Care Fight

Law360, Washington (March 13, 2012, 6:48 PM EDT) -- The U.S. Department of Justice on Monday urged the D.C. Circuit to uphold a ruling that the government adequately responded to a conservative group’s Freedom of Information Act request for documents linking U.S. Supreme Court Justice Elena Kagan to the health care reform law.

The Media Research Center appealed the Washington federal court ruling in November, arguing that the government's FOIA search didn't turn up documents from specific meetings and improperly labeled others as personal materials although they stemmed from Justice Kagan's Supreme Court nomination....
