GSK Asks High Court To Buck DOL On Sales Reps' OT Status

Law360, New York (March 19, 2012, 9:26 PM EDT) -- GlaxoSmithKline PLC on Monday urged the U.S. Supreme Court to rule that its sales representatives are exempt from overtime pay requirements, saying the high court should give no deference to the U.S. Department of Labor's position that they are not outside salesmen.

The Supreme Court in November agreed to consider the status of GSK's sales reps, taking up an appeal lodged by two of the company's sales reps of a Ninth Circuit decision that found them exempt from the Fair Labor Standards Act's overtime requirements. The...
