Hospital Asks 3rd Circ. To Drop Judge In Antitrust Row

Law360, New York (March 14, 2012, 5:00 PM EDT) -- West Penn Allegheny Health System Inc. asked the Third Circuit earlier this month to disqualify a Pennsylvania federal judge from an antitrust lawsuit against rival hospital network UPMC, saying the judge was dragging his feet.

In a petition for writ of mandamus filed March 2, West Penn alleged U.S. District Judge Arthur J. Schwab has effectively barred the case from going forward, in opposition to the Third Circuit’s January 2011 decision that the case should proceed.
