D.C. Appeals Court Tosses Out FERC Order

Law360 (August 8, 2007, 12:00 AM EDT) -- An appellate court has sent the Federal Energy Regulatory Commission back to the drawing board over the so-called proxy groups used to determine gas transmission rates for two energy companies, after the pair protested the arrangements.

On Tuesday, the U.S. Court of Appeals for the District of Columbia reversed and remanded FERC's previous order, ruling that the Commission had “erred” in its application of proxy groups for Petal Gas Storage LLC, and High Island Offshore System LLC.
