US-Ohio Coal Mining Suit Reopens After Talks Collapse

Law360, New York (March 14, 2012, 7:30 PM EDT) -- Following a breakdown in settlement talks, a federal judge on Wednesday reopened the U.S. government's suit accusing Ohio of reneging on a 1948 land agreement by allowing coal mining beneath a flood control reservoir.

U.S. Magistrate Judge Terence P. Kemp lifted a stay that had been in place since August, saying that mediation between the U.S. and defendants Ohio and Buckingham Coal Co. had stalled.

"The parties agreed that over the past several months, their mediation efforts did not progress," Judge Kemp said.
