Court Keeps Alive Medicare Fraud Suit Against Sun

Law360, New York (August 8, 2007, 12:00 AM EDT) -- An appeals court has remanded part of a whistleblower action against Sun Healthcare Group while also affirming a lower court decision to throw out three of the 10 claims in the Medicare overbilling suit.

In its decision, a three-judge panel for the U.S. Court of Appeals for the Tenth Circuit on Tuesday overturned part of a lower court decision and kept alive the bulk of the qui tam case brought by Louanne Boothe.
