Ark. High Court Rejects Debt-Collect Fee Cap For Attys

Law360, New York (March 15, 2012, 5:19 PM EDT) -- Fees levied by debt collection law firm Bennett & DeLoney PC against thousands of Arkansas consumers were exempt from limits imposed under state law, the Arkansas Supreme Court ruled Thursday in dismissing a case against the company.

In 2008, state Attorney General Dustin McDaniel launched a consumer-protection action against the Utah-based firm and principals Michael Bennett and Richard DeLoney, accusing them of overcollecting more than $360,000 from nearly 3,600 Arkansas consumers.
