11th Circ. Lets Amerisure Dodge $2M Bill For Shoddy Roof

Law360, New York (March 16, 2012, 2:16 PM EDT) -- The Eleventh Circuit on Thursday held that Florida inn owner Amelia Island Co. could not collect $2.2 million from Amerisure Mutual Insurance Co. for a shoddily constructed roof because the policy did not cover the subcontractor's defective work.

Under Florida law, the Amerisure standard commercial general liability insurance policy will not cover roof damage caused by faulty work by the subcontractor, hired by construction company Auchter Co., that only affects the roof constructed by the subcontractor and no other elements around it, the appeals panel said....
