Countervailing Duty Law Unconstitutional, Tire Co. Says

Law360, New York (March 23, 2012, 7:09 PM EDT) -- A new law allowing the U.S. government to apply countervailing duties to imports from nonmarket economies should be found unconstitutional because it applies retroactively, the Chinese tire company at the center of the case that prompted Congress to act told the Federal Circuit on Friday.

Also Friday, the government urged the Federal Circuit to vacate its December ruling that countervailing duties cannot be applied to goods from nonmarket economy countries in light of the new law, and to remand the case to the U.S. Court of...
