Court Nixes Boston Scientific's Bid For Lumen Patent

Law360 (August 9, 2007, 12:00 AM EDT) -- An appeals court on Wednesday denied Boston Scientific Scimed Inc.'s bid to claim patent rights over a prosthetic device, called a lumen, manufactured by medical technology company Medtronic Inc., upholding a district court's summary judgment from last year.

The dispute began in 1998, when Boston Scientific initiated an interference in Medtronic's application with the U.S. Patent and Trademark Office on a lumen. Medtronic had filed the application in 1994.
