7th Circ. Calls On DOL To Reconsider Injury Log Reg

Law360, New York (March 20, 2012, 6:27 PM EDT) -- The Seventh Circuit on Tuesday struck down Secretary of Labor Hilda Solis' decision to fine Caterpillar Logistics Services Inc. for not recording an employee injury and said the secretary should consider nixing the requirement that employers log only "work-related" illnesses, injuries and deaths.

The appeals court-issued nine-page panel opinion, written by Chief Judge Frank Easterbrook and granting Caterpillar's petition for review, vacated the secretary's decision and remanded the matter for further proceedings.
