Katrina Emissions Suit Against Oil Cos. Rejected Again

Law360, New York (March 21, 2012, 6:35 PM EDT) -- A federal judge on Tuesday dismissed Mississippi property owners' second suit accusing Hess Corp. and other oil giants of releasing emissions that ultimately caused Hurricane Katrina, ruling the owners can't trace their alleged injuries to the oil companies' emissions.

Chief U.S. District Judge Louis Guirola ruled Tuesday the proposed class of property owners led by Ned Comer does not have standing to pursue its claims, that the Clean Air Act pre-empts the claims and that the suit poses a political question that courts should not decide....
