Union Says NLRA Preempts Ind. Right-To-Work Law

Law360, New York (March 23, 2012, 6:43 PM EDT) -- The union suing over Indiana's new right-to-work law on Friday fired back at Gov. Mitch Daniels' bid to nix its suit, again asserting that the law is unconstitutional and preempted by the National Labor Relations Act.

In a 53-page memorandum filed in Indiana federal court in opposition to the defendants' motion to dismiss the suit, the International Union of Operating Engineers Local 150 also maintained that Daniels and Indiana Attorney General Greg Zoeller could not claim immunity from the suit and that its claims were ripe...
