FWS Issues Wildlife Guidelines For Wind Power Cos.

Law360, New York (March 23, 2012, 4:10 PM EDT) -- The U.S. Fish and Wildlife Service released voluntary guidelines Friday that explain the wildlife impact studies that onshore wind energy developers should perform before and after a project's construction in order to help avoid punishment from the agency.

The new recommendations replace voluntary interim guidelines issued by the agency in July 2003. They take effect immediately, the FWS said.

The agency cautioned that adherence to the guidelines did not protect companies from enforcement actions, but that it would account for documented efforts to follow the recommendations...
