Fed. Circ. Restores 3M's Sheeting IP Case Against Avery

Law360, New York (March 26, 2012, 6:21 PM EDT) -- The Federal Circuit on Monday revived 3M Co.'s lawsuit seeking a declaration that its products do not infringe Avery Dennison Corp.'s patents covering retroreflective sheeting, finding that a genuine controversy of fact does exist in the case.

A three-judge panel remanded the case after vacating a lower court's dismissal, ruling that the district court erred when it held that it had no jurisdiction over the declaratory judgment suit because 3M had failed to prove that a case or controversy existed between the parties.
