Bill Would Allow Labeling Suits Against Generics Cos.

Law360, New York (March 27, 2012, 2:14 PM EDT) -- Sen. Patrick Leahy, D-Vt., plans to introduce legislation as soon as this week that would reverse last year's U.S. Supreme Court decision in Pliva v. Mensing, which shields generic-drug makers from product liability suits over warning labels, the senator announced Monday.

Leahy said the high court ruling, which prevents consumers from filing state-law tort claims against generics manufacturers, threatens the safety of generic drug users and creates a “troubling inconsistency” in prescription drug law.
