Fed. Circ. Orders Arbitration In Gene Test Royalty Row

Law360, New York (March 28, 2012, 4:46 PM EDT) -- The Federal Circuit on Wednesday ordered Promega Corp. to arbitrate a dispute with rival Life Technologies Inc. over an alleged failure to pay royalties as required by a licensing agreement on a genetic testing patent.

Under the terms of an agreement which dates to 1996, Promega was required to pay an initial licensing fee for products using a Research Genetics Inc. patent — U.S. Patent Number RE37,984 — and royalties on sales of products relying on the technology.
