3rd Circ. Boots Judge From West Penn Antitrust Case

Law360, New York (March 29, 2012, 6:40 PM EDT) -- The Third Circuit on Wednesday replaced the Pennsylvania federal judge presiding over West Penn Allegheny Health System Inc.'s antitrust lawsuit against rival hospital network UPMC, following allegations that he refused to move the case forward because of bias.

The appeals court granted a petition for writ of mandamus filed earlier this month by West Penn that alleged U.S. District Judge Arthur J. Schwab had refused to allow the case to proceed, flouting the Third Circuit's January 2011 decision to the contrary.
