Judge Trims CERCLA Suit Over Toxic GE Transformers

Law360, New York (April 2, 2012, 8:08 PM EDT) -- An Ohio federal judge on Saturday dismissed a large portion of a Comprehensive Environmental Response, Compensation and Liability Act suit against General Electric Co. over allegedly defective transformers, ruling some claims were barred by statutes of limitations while allowing others to move forward.

Judge Michael R. Barrett tossed most of American Premier Underwriters Inc.'s claims for contribution and recovery costs under CERCLA, dismissing all but two. The judge also threw out all of APU's claims for state environmental law violations but kept alive a state common...
