Judge Snuffs Out Mass. City's Ban On Outdoor Tobacco Ads

Law360, New York (April 2, 2012, 4:39 PM EDT) -- A federal judge ruled Saturday that a Worcester, Mass., law banning outdoor ads for tobacco products unconstitutionally prohibited free speech, handing a victory to Philip Morris USA Inc., Lorillard Tobacco Co., R.J. Reynolds Tobacco Co. and a group of tobacco sellers.

U.S. District Judge Douglas P. Woodlock granted summary judgment to the plaintiffs, who challenged May 2011 revisions to a city ordinance that prohibited ads for cigarettes, blunt wraps and other tobacco products that could be seen from a city street or park.
