Reps. Tout Bill Giving Generics Cos. Leg Up On Exclusivity

Law360, New York (April 4, 2012, 5:15 PM EDT) -- Newly proposed legislation would give generic-drug makers a boost when vying for market exclusivity by giving a patent challenger more time to win approval from the U.S. Food and Drug Administration, the bill's sponsors announced Tuesday.

Under current law, the first generics company to challenge a pharmaceutical patent can get 180 days of market exclusivity once their generic is approved — but only if the generic wins tentative approval from the FDA within 30 months.
