S. Africa High Court Ratchets Up Antitrust Tribunal's Powers

Law360, New York (April 13, 2012, 6:40 PM EDT) -- South Africa's competition court has leeway to expand the scope of its inquiries beyond the letter of complaints referred to it by the antitrust enforcer, the country's highest court ruled Thursday, tossing earlier limits on the tribunal's powers.

The decision from the Constitutional Court undoes an earlier victory for grain storage provider Senwes Ltd., which had convinced the Supreme Court of Appeal to rule that the Competition Tribunal — the first court to hear competition complaints from the country's Competition Commission — had overstepped its authority....
