Australians Get Priority On HPV Vaccine Patent

Law360 (August 21, 2007, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit ruled Monday that a patent application filed by scientists in Australia for a human papilloma virus vaccine process has priority in the United States over a similar patent application filed by American inventors.

The ruling reversed an earlier decision by the U.S. Patent and Trademark Office that the Australian patent had not established priority because it had disclosed scientific findings that the inventors later found to be false.
