Genzyme Negligence Suit Won't Get High Court Hearing

Law360, New York (April 16, 2012, 12:16 PM EDT) -- The U.S. Supreme Court on Monday declined to review Genzyme Corp.'s win in a negligence suit arguing the company should be held responsible for a botched knee surgery because it did not properly train the patient's doctor.

Challenging the Eleventh Circuit's dismissal of her suit, patient Denise Rounds argued Genzyme was at fault for not instructing her surgeon how to determine which patients were candidates for Carticel, a cartilage repair product whose misapplication in a 2007 surgery led to several follow-up procedures.
