Ford's $2.6M Export Tax Appeal Denied By Fed. Circ.

Law360, New York (April 16, 2012, 3:53 PM EDT) -- Ford Motor Co. on Monday was again denied a refund of $2.6 million in harbor maintenance taxes dating back to 1987 after the Federal Circuit affirmed that the automaker had failed to prove it had actually made the payments.

The appellate court affirmed the U.S. Court of International Trade's 2010 ruling that without reliable documentation demonstrating that U.S. Customs and Border Protection had received the taxes, Ford cannot prove that it actually made two sets of payments at issue in the dispute.
