Lilly Sues Apotex Over Lung Cancer Drug Patent

Law360, New York (April 18, 2012, 12:19 PM EDT) -- Eli Lilly & Co. sued generic-drug maker Apotex Inc. on Tuesday in Indiana federal court over its alleged infringement of a patent on Eli Lilly's chemotherapy drug Alimta, used to treat several types of lung cancer.

Toronto-based Apotex has plans to create a generic version of Alimta, and included in its abbreviated new drug application with the U.S. Food and Drug Administration a method for administering the chemotherapy agent in combination with folic acid and vitamin B12, which would be detailed on the generic's labeling, the...
