Liquor Deal Termination OK Under Sherman Act, 8th Circ. Told

Law360, New York (April 19, 2012, 6:02 PM EDT) -- Brown-Forman Corp. on Tuesday told the Eighth Circuit not to revive a suit alleging the liquor supplier's nixing of distribution agreements with Johnson Brothers Liquor Co. ran afoul of antitrust law, saying the contract terminations did not restrain competition.

In a brief, Brown-Forman, producer of Jack Daniel's whiskey and Southern Comfort liqueur, urged the appeals court to deny the Johnson Brothers appeal, which claims that a Minnesota federal judge overlooked key facts and misinterpreted the applicable antitrust law.
