State Can't Intervene In FERC Cases, Mo. High Court Rules

Law360, New York (April 18, 2012, 6:57 PM EDT) -- The Missouri Supreme Court on Wednesday said the state Public Service Commission has no authority to intervene in matters pending before the Federal Energy Regulatory Commission, nullifying the agency's protests of MoGas Pipeline LLC's business proposals currently before FERC.

In a 4-3 decision, the state Supreme Court affirmed a lower court's opinion that if a power is not granted to the PSC by Missouri statute, then the PSC does not have that power, and intervening in a FERC proceeding is not included in its powers....
