Aetna, Cigna Prevail In Joint Implant Maker's Suit

Law360 (August 23, 2007, 12:00 AM EDT) -- An appeals court has come down in favor of insurers Aetna Inc. and Cigna Corp. in a joint implant maker's lawsuit that claimed they had disparaged its products by labeling them “experimental” and “investigational,” deeming the statements expressions of opinion.

TMJ Implants Inc. on Wednesday lost its attempt in the U.S. Court of Appeals for the Tenth Circuit to hold the insurers liable for making what it saw as disparaging descriptions of its jaw implants, which are used to treat the jaw disorder TMJ.
