Appeals Court Blesses Whole Foods, Wild Oats Deal

Law360, New York (August 24, 2007, 12:00 AM EDT) -- The merger of Whole Foods Market, Inc. and Wild Oats Markets Inc. cleared its last legal hurdle on Thursday when a federal appeals court denied a request by the Federal Trade Commission to stay the case pending an appeal.

The U.S. Court of Appeals for the District of Columbia said that the FTC failed to show that the lower court abused its discretion by making clearly erroneous factual findings or errors of law in denying the requested preliminary injunction.
