Appeals Court Dismisses Moody's Suit

Law360 (August 24, 2007, 12:00 AM EDT) -- An appeals court agreed with a district court that Moody's Investors Services, Inc. did not defame Compuware Corp. when it lowered its stock value because of copyright suit with IBM.

In the decision Thursday, the three-judge panel of the U.S. Court of Appeals for the Sixth Circuit decided 2-1 that Compuware failed to establish actual malice, which it said was required in the case. Judge John Rogers concurred in part and dissented in part.
