Law360, New York (April 24, 2012, 8:45 PM EDT) -- An Arkansas federal judge on Monday declined to toss a discrimination suit brought by the U.S. Equal Opportunity Employment Commission on behalf of a former Old Dominion Freight Line Inc. driver who was barred from driving for being an alcoholic, finding the EEOC should clarify its complaint instead.
Old Dominion claimed the complaint was unclear on whether the EEOC intended to plead a "pattern or practice" claim, and asked that the EEOC be “required to properly and clearly plead the nature of its claims."
