Ex-Census Worker Asks 7th Circ. To Revive Retaliation Suit

Law360, Chicago (April 25, 2012, 5:42 PM EDT) -- A former U.S. Census Bureau employee on Wednesday asked the Seventh Circuit to revive her suit alleging retaliation for her sexual harassment complaint, saying an Indiana district court had wrongly ruled for the government because issues of material fact were still in dispute.

"Obviously there is a dispute," Michael Eisenberg, plaintiff Kimberly Cain's attorney, said at oral arguments. "There is a dispute in fact. And that's why summary judgment is not proper here."
