Customs Pays $40M Byrd Amendment Sum To Stanley Furniture

Law360, New York (April 27, 2012, 8:57 PM EDT) -- Because the Federal Circuit has refused to bar the distribution of Byrd Amendment funds as litigation over the long-repealed trade statute continues, U.S. Customs and Border Protection has recently paid out millions under the program, including $40 million to Stanley Furniture Co. Inc. on Wednesday.

On March 5, the Federal Circuit denied motions for an injunction by several companies challenging the constitutionality of the law, which was repealed in 2006. The appeals court said the denial will not prejudice the ultimate outcome of the challengers' cases...
