NY Bar Pushes For Expanded Expert Disclosure Rule

Law360, New York (April 27, 2012, 5:27 PM EDT) -- The New York Bar Association on Thursday proposed an expanded expert discovery disclosure rule for commercial cases in Empire State courts in a bid to avoid "trial by ambush" in contract, malpractice and business tort disputes where the stakes routinely run into the billions of dollars.

The rule, crafted by the New York State Bar Association's Commercial and Federal Litigation Section, would mitigate litigation risks that are causing parties to choose federal court rather than state court whenever possible, the proposal said.
