Polyester Staple Class Withstands Challenge

Law360 (August 28, 2007, 12:00 AM EDT) -- Ignoring defendants' protests, a federal appeals court has upheld a lower court's decision to grant class status to a group of plaintiffs in the longstanding multidistrict antitrust litigation over an alleged conspiracy to fix the price of polyester staple fiber.

On Tuesday, the U.S. Court of Appeals for the Fourth Circuit knocked down Arteva Specialties' attempt to appeal the certification order, denying the company permission to challenge the ruling.
