EPA Issued Air Pollution Regs Sans Public Review, NRDC Says

Law360, New York (May 1, 2012, 6:20 PM EDT) -- The Natural Resources Defense Council sued the U.S. Environmental Protection Agency in the D.C. Circuit on Monday, alleging the agency illegally issued states guidance on implementing air pollution standards for soot particles without any opportunity for public review, violating the Clean Air Act.

The environmental group says an EPA memorandum offering states guidance on implementing fine particulate matter pollution standards from 2006 effectively extended regulations issued under former President George W. Bush for implementing less-stringent standards from 1997.
