Ohio Court Overrules FirstEnergy's Fuel Deferrals

Law360, New York (August 30, 2007, 12:00 AM EDT) -- An Ohio court has ruled that the state’s public utility commission violated the law when it allowed FirstEnergy Corp. to defer costs relating to increased fuel prices from 2006 through 2008.

On Wednesday, the Supreme Court of Ohio ruled that the Public Utilities Commission of Ohio violated a state law by allowing three electric utilities owned by FirstEnergy to collect deferred increased fuel costs through future energy rate increases.
