Owens Corning Rival Can't Beat Re-Exam Stay Of Patent Suit

Law360, New York (May 11, 2012, 5:31 PM EDT) -- A Pennsylvania federal judge ruled Tuesday that a stay in a patent infringement case against Owens Corning Corp. pending re-examination of the patents will not prejudice plaintiff Air Vent Inc., even though the companies are direct competitors.

In his ruling, U.S. District Judge Terrence F. McVerry noted that courts are generally more likely to find that a stay would unduly prejudice the plaintiff when the parties directly compete, but ruled that the presence of other competitors in the relevant market mitigates the risk of prejudice....
