McKenzie-Willamette Suffers Blow In Antitrust Dispute

Law360 (September 4, 2007, 12:00 AM EDT) -- A federal appeals court has knocked down a verdict and a $16.2 million award in favor of McKenzie-Willamette Hospital in its antitrust suit against a rival Oregon county hospital.

The U.S Court of Appeals for the Ninth Circuit on Tuesday vacated the jury’s verdict, which sided with McKenzie-Willamette’s allegation that PeaceHealth took part in attempted monopolization, finding that a district court gave the jury improper guidance regarding the anti-competitive effect of bundled discounting.
