Federal Circuit Upholds Verdict Vs. Smith & Nephew In Patent Suit, Revives Antitrust Suit Vs. ArthroCare

Law360, New York (May 11, 2005, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit has affirmed in part a jury verdict in medical device maker ArthroCare Corp.’s patent infringement lawsuit against rival Smith & Nephew, but revived Smith & Nephew’s countersuit based on antitrust claims against ArthroCare and Ethicon.

The court rejected Smith & Nephew's challenges against two ArthroCare patents, affirming the jury's verdict that all of the asserted claims of those two patents are valid and were infringed by Smith & Nephew.
