NLRB Overreached With Union Posting Rule, DC Circ. Hears

Law360, New York (May 23, 2012, 4:34 PM EDT) -- Business groups told the D.C. Circuit on Tuesday that the National Labor Relations Board lacked the authority to issue its controversial rule requiring employers to put up posters informing workers of their right to unionize and that the rule interferes with employers' First Amendment rights.

The National Association of Manufacturers and others are asking the appeals court to overturn U.S. District Judge Amy Berman Jackson's ruling affirming the NLRB's authority to mandate the posters.
