Delaware District Court Hears Sanofi-Aventis Trademark Suit Vs. Advancis Pharma

Law360 (May 12, 2005, 12:00 AM EDT) -- A Delaware district court is hearing arguments this week in French drug giant Sanofi-Aventis’ trademark infringement lawsuit against upstart Advancis Pharmaceutical Corp.

Sanofi-Aventis filed its lawsuit in U.S. District Court for the District of Delaware in December 2003, arguing that the Advancis trademark and name are confusingly similar phonetically and visually to Aventis'.

The complaint contains six counts, based upon both federal and state law. The drug maker is seeking injunctive relief as well as unspecified monetary damages.
