State Workers Can't Get FMLA Damages, Iowa High Court Says

Law360, New York (May 25, 2012, 6:55 PM EDT) -- Iowa's highest court ruled Friday that state employees cannot sue for damages under the Family and Medical Leave Act's self-care provision, finding the state had not waived its sovereign immunity.

Because it found state employees could not recover damages for being illegally fired for taking time off for their own medical issues under the FMLA, the Iowa Supreme Court nixed a jury's $165,122 jury award to Tina Lee, a former employee of the Polk County Clerk of Court who was demoted and then axed in 2004...
