Law360 (September 11, 2007, 12:00 AM EDT) -- Consol Energy Inc. has sought at least $10 million in a trespassing lawsuit that accuses Bluestone Coal Co. of pumping water from an underground waterway that Consol owns.
According to a complaint filed Monday with the U.S. District Court for the Southern District of West Virginia, Bluestone owns the rights to a seam of coal in McDowell County, W. Va., while Consol owns the rights to all strata below the seam of coal. However, Bluestone has drilled water wells on the property well below the coal seam, which have damaged water quality and the stability of the watercourse, the complaint said....
