DC Circ. Tells Armey To Take Up Medicare Beef With Insurer

Law360, New York (May 30, 2012, 7:24 PM EDT) -- The D.C. Circuit on Wednesday refused to rehear former U.S. House Majority Leader Dick Armey's suit seeking the ability to disclaim entitlement to Medicare Part A in order to get better hospital coverage from a private insurer, saying the issue could be resolved only by the insurer, not the court.

The suit — which names Secretary of Health and Human Services Kathleen Sebelius and Social Security Commissioner Mark J. Astrue as defendants — had claimed Armey's and four other plaintiffs' private insurers offered less hospital coverage...
