Plastics Co. Sues Insurers Over Superfund Liability Coverage

Law360, New York (June 1, 2012, 3:47 PM EDT) -- Teknor Apex Co. on Thursday accused three insurers including Hartford Accident & Indemnity Co. of breaching their contracts by denying coverage for defense costs in underlying pollution lawsuits the vinyl and plastics manufacturer is facing.

Pawtucket, R.I.-based Teknor Apex said it has environmental liabilities as a result of its business operations, including for alleged contamination at the Peterson-Puritan Inc. Superfund site in Cumberland, R.I., which was designated by the U.S. Environmental Protection Agency under the Comprehensive Environmental Response, Compensation and Liability Act.
